HAQM One Medical Pay-per-visit Terms of Use

Thank you for using HAQM One Medical Pay-per-visit (“HAQM One Medical PPV”). HAQM VHS LLC operates the HAQM One Medical PPV virtual healthcare storefront through which telehealth services are offered by One Medical professional corporations and the affiliated medical services providers (collectively, “OM Providers”). HAQM VHS LLC makes website features and other products and services available to you when you visit the HAQM One Medical PPV website, use HAQM One Medical PPV products or services, interact or communicate with an OM Provider or interact or communicate with HAQM One Medical PPV (collectively, “HAQM One Medical PPV Services”).

These HAQM One Medical PPV Terms of Use supplement the terms and conditions set forth in the HAQM.com Conditions of Use and HAQM.com Privacy Notice. Before using HAQM One Medical PPV Services, please read the HAQM.com Conditions of Use, HAQM.com Privacy Notice, and these HAQM One Medical PPV Terms of Use (collectively, the “Agreement”). By using HAQM One Medical PPV Services, you agree to be bound by the terms of the Agreement. If you do not agree to the terms of the Agreement, you may not use HAQM One Medical PPV Services. If you purchase a telehealth visit from HAQM One Medical PPV Services, the HAQM One Medical PPV Medical Terms of Services will govern the telehealth services.

Through HAQM One Medical PPV physicians, physician assistants, nurse practitioners, and other medical professionals affiliated with the OM Providers (“Clinicians”) provide telehealth services to customers. HAQM VHS LLC, the operator of the HAQM One Medical PPV storefront, does not practice medicine or nursing, and does not interfere with or otherwise influence the Clinicians’ exercise of their professional judgment in providing healthcare services. Each Clinician is responsible for exercising their own professional judgment and complying with all requirements applicable to their profession and license.

Protected Health Information (“PHI”) is defined in the Health Insurance Portability and Accountability Act of 1996 (commonly referred to as HIPAA), and includes individually identifiable information such as a person’s medical history, diagnoses, treatments, current medical condition, and use of prescription medications. When PHI is collected or used by an OM Provider (or is received by HAQM VHS LLC in its capacity as a service provider to an OM Provider), it is governed by the OM Providers’ HIPAA Notice of Privacy Practices, and not the HAQM.com Privacy Notice. Please see the OM Providers’ HIPAA Notice of Privacy Practices for more information on HIPAA, PHI, and your rights with respect to your PHI.

You may only use HAQM One Medical PPV Services if you are eligible. By using HAQM One Medical PPV Services, you acknowledge and agree that: (i) you are not enrolled in any Medicare or Medicaid program or plan; (ii) you will pay directly for any medical services provided and products or drugs prescribed to you; and (iii) OM Providers will not bill any other third party, including a federal or state healthcare program, for such medical services or prescribed drugs or products. HAQM One Medical PPV reserves the right to make changes to our eligibility criteria at any time. In the event that you lose eligibility for HAQM One Medical PPV Services, HAQM One Medical PPV may suspend your access to HAQM One Medical PPV Services, but you may still access your PHI in accordance with the OM Providers’ HIPAA Notice of Privacy Practices.

Certain HAQM One Medical PPV Services are currently only available in a limited service area. Through the HAQM One Medical PPV virtual health storefront and/or the HAQM.com mobile application, HAQM One Medical PPV determines which HAQM One Medical PPV Services are available to you, based on your location. You agree to refrain from using any technology or technique to obscure or disguise your location when using HAQM One Medical PPV Services.

You will need an HAQM.com profile to use HAQM One Medical PPV. If you are under 18 or 65 or older, you may not use HAQM One Medical PPV Services. You agree to provide and maintain true, current, and complete information about yourself in the profile. You can establish and use additional profile-protection features offered by HAQM One Medical PPV to create and access the HAQM One Medical PPV Service. Each adult who shares an HAQM.com account with other members of their household will need to create their own profile in order to use the HAQM One Medical PPV Services.

Health-related content provided by HAQM One Medical PPV that is not provided directly from OM Providers is for reference only and describes general principles of healthcare and side effects related to common medications. Such content is not intended to be specific instructions or medical advice for any individual patients. If you have any questions about health-related content, please contact HAQM One Medical PPV at 888-663-6331 or contact your OM Provider or your preferred healthcare provider.

You consent to receive communications (including emails, texts, mobile push notifications, or notices and messages on HAQM.com, the HAQM One Medical PPV virtual health storefront, or through other HAQM One Medical PPV Services) by or on behalf of HAQM VHS LLC or the OM Providers to any email address, phone number, or mobile device associated with your HAQM.com account or otherwise directly or indirectly provided to HAQM. Communications HAQM One Medical PPV sends to you may include information about your treatment, benefits, or HAQM One Medical PPV account, and, in connection with such communications, HAQM One Medical PPV may use pre-recorded/artificial voice messages and/or automatic dialing devices. If you choose to share access to your mobile phone, carrier account, email, or HAQM One Medical PPV profile with others, those individuals might also be able to see this information. The OM Providers’ HIPAA Notice of Privacy Practices provides more information on how you may receive communications from HAQM One Medical PPV.

The HAQM.com Privacy Notice governs all information gathered by HAQM VHS LLC in connection with HAQM One Medical PPV Services that is not PHI (for example, version and time zone settings, device type, or operating system associated with the HAQM.com mobile application).

You will have the opportunity to review the HAQM One Medical PPV Medical Terms of Service prior to seeking telehealth services from the OM Provider. If you do not accept the HAQM One Medical PPV Medical Terms of Service, the OM Providers will not be able to provide telehealth services to you.

OM Providers may prescribe medication to you if they determine it to be appropriate to treat your condition. If you request that your prescription be sent to your preferred pharmacy, then you are responsible for picking up or arranging for delivery of the medication. You are responsible for providing the dispensing pharmacy with your health insurance information and for paying any charges owed for medication, including co-pay, co-insurance, deductible, and all associated fees arising as a result of the prescription. The total cost for the telehealth visit with HAQM One Medical PPV does not include the cost of any prescription medication.

HAQM VHS LLC may terminate your rights under this Agreement without notice if you fail to comply with any of its terms. Further, HAQM VHS LLC may terminate or suspend your access to and use of the HAQM One Medical PPV Services and/or your HAQM One Medical PPV profile without notice, for any reason, at any time. In case of such termination, HAQM VHS LLC may revoke your access to HAQM One Medical PPV Services. If your HAQM One Medical PPV profile is suspended or terminated, you may still access your PHI in accordance with the OM Providers’ HIPAA Notice of Privacy Practices. HAQM VHS LLC’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

HAQM VHS LLC reserves the right, at any time, to (a) make changes to or end the HAQM One Medical PPV Services, and (b) make changes to the Agreement. Your continued use of HAQM One Medical PPV Services following the publication of changes to this Agreement means that you continue to agree to its terms, including the HAQM One Medical PPV help content, and all other applicable rules, policies, and terms posted on the HAQM One Medical PPV website. If any of these terms is deemed invalid, void, or for any reason unenforceable, that term is deemed severable and will not affect the validity and enforceability of any remaining terms.

OM PROVIDERS ARE SOLELY RESPONSIBLE FOR THE PROVISION OF HEALTHCARE SERVICES. AMAZON VHS LLC HAS NO RESPONSIBILITY OR LIABILITY FOR HEALTHCARE SERVICES PROVIDED BY THE OM PROVIDERS. EACH OM PROVIDER MAY CHANGE OR DISCONTINUE ITS HEALTHCARE SERVICES AT ANY TIME, AND AMAZON VHS LLC HAS NO OBLIGATION TO PROVIDE NOTICE TO YOU.

This Agreement is governed by the laws of the State of Washington, without reference to its conflict of law rules. Each party agrees to exclusive personal jurisdiction and venue in the federal and state courts in King County, Washington, for any dispute arising out of this Agreement.
